USER AGREEMENT

IMPORTANT: BEFORE USING OR OTHERWISE BENEFITING FROM ANY SERVICE/PRODUCT PROVIDED BY MB OYUN YAZILIM VE PAZARLAMA ANONİM ŞİRKETİ (“MB Oyun”), YOU MUST READ THIS USER AGREEMENT. BY ACCESSING ANY PRODUCT OR SERVICE PROVIDED BY MB Oyun IN ANY WAY, INCLUDING BUT NOT LIMITED TO USING ANY SERVICE/PRODUCT AVAILABLE ON THIS WEBSITE, CREATING AN ACCOUNT, DOWNLOADING ZULA STRIKE, PLAYING IT, OR CLICKING “I ACCEPT,” YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THIS AGREEMENT AND ALL ITS ANNEXES (INCLUDING THE PRIVACY AGREEMENT AND THE CLARIFICATION TEXT ON THE PROTECTION OF PERSONAL DATA). IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT, YOUR USE OF PRODUCTS AND SERVICES PROVIDED BY MB Oyun, INCLUDING ZULA STRIKE, IS STRICTLY PROHIBITED.

Article 1 – Subject, Acceptance, and Amendments of the Agreement

The subject of this User Agreement (“Agreement”) is to define the rights and obligations between MB Oyun Yazılım ve Pazarlama Anonim Şirketi (“MB Oyun”) and the User regarding the use of the game titled “Zula Strike” and all products and services provided in connection with this game (“Services”). This Agreement covers the rules and conditions applicable to the User’s access to Zula Strike, creation of an account, playing of the game, and benefit from all other services offered by MB Oyun.

As stated at the beginning of this Agreement, the User will be deemed to have read, understood, and accepted this Agreement, to have been informed about the obligations herein, and to have committed to comply with them if they, in any way, benefit from any map, character, product, service, or feature belonging to MB Oyun within Zula Strike, or access the Services in any manner, whether related to Zula Strike or not. If the User does not accept the terms of this Agreement or other rules regarding the use of the Services, they must immediately cease using Zula Strike and all related Services.

The User has the right to forward any questions, opinions, or suggestions regarding this Agreement to MB Oyun via https://zulastrike.zendesk.com/hc or contact@madbytegames.com.

MB Oyun reserves the right, at its sole discretion, to unilaterally amend, update, or modify this Agreement and any rules and policies related to the Services at any time, for operational, legal, or other reasons. Any such changes will take effect immediately upon being published in updated form on the Zula Strike website and shall be binding on the User. MB Oyun may, but is not obligated to, notify Users of significant changes via in-game notifications or other reasonable means. The User’s continued use of Zula Strike or the Services after publication of the changes constitutes acceptance of the updated Agreement. If the User does not accept the updated terms, they must immediately stop using Zula Strike and all Services. It is solely the User’s responsibility to review this Agreement regularly and to stay informed of the current terms.

Article 2 – User Account

To access and use the Services provided by MB Oyun, the User must create a Zula Strike account (“Account”). Accounts may only be created by natural persons acting in their own name. By accepting this Agreement or accessing the Services, the User declares that they have the legal capacity to enter into a binding contractual relationship.

The User acknowledges that creating an Account and accessing the Services may require the consent of a legal representative, parent, or guardian. In cases where such consent is required (e.g., minors, legal incapacity), the User agrees to ensure that their legal representative is fully informed prior to participation or to provide MB Oyun with the necessary information to obtain such consent.

The User must be at least 15 years old to access and use the Services. If the User is over 15 but under 18 (“Minor User”), it is deemed that they have reviewed this Agreement together with their parent or guardian and created the Account with their consent. In such case, the legal parent/guardian is deemed to have:
(i) consented to this Agreement;
(ii) accepted all responsibility for the Minor User’s use of the Account and access to the Services;
(iii) approved and accepted financial responsibility for all purchases made through the Account.

The creation or use of an Account on behalf of any person other than the User is strictly prohibited. Any criminal or civil liability arising from such actions is solely the responsibility of the User.

Zula Strike and other Services provided by MB Oyun may not be suitable for all age groups. The parent or guardian permitting a Minor User to play Zula Strike or use the Services is solely responsible for determining and monitoring whether the content is appropriate for their child.

The User agrees to provide accurate, complete, and up-to-date information during and after account creation, including email address, date of birth, and any other information MB Oyun may require, and to keep this information current. Providing false, misleading, or another person’s identity or personal data is strictly prohibited. MB Oyun reserves the right to suspend or permanently terminate the Account without prior notice if it suspects or determines the information provided is false.

The User is solely responsible for maintaining the security of their username, password, and any other access credentials, and for taking necessary precautions to prevent them from being obtained by others.

The User may not transfer, share, sell, or trade their account credentials, usernames, or other access elements to other persons for any reason, whether for compensation or not.

The User may not select or use any account name or in-game nickname that:

• infringes the rights of a third party (e.g., trademark, personal name);

• impersonates an MB Oyun employee, executive, or support staff;

• is obscene, vulgar, pornographic, racist, hateful, offensive, promotes illegal activities, or is contrary to public morals;

• contains personal information (e.g., address, phone number);

• contains commercial purposes or advertising (e.g., website address).

MB Oyun has sole discretion to decide whether a name violates these rules and may change the name, suspend the Account, or terminate it without prior notice.

Article 3 – Intellectual and Industrial Rights, Restrictions, and Prohibitions

Zula Strike, including Zula PC, Zula Battle Royale, and any future versions, platforms, and content, along with all related Services provided by MB Oyun, and every kind of use, organization, and disposition stated in this Agreement, are, unless otherwise specified or understood from the nature of the matter, the sole property of MB Oyun. The term “MB Oyun” refers to the trademark of MB Oyun Yazılım ve Pazarlama Anonim Şirketi.

All in-game content, materials, documents, information, graphics, designs, products, in-game accounts, in-game items, email services, software, updates, and similar services provided within Zula Strike are protected under applicable Intellectual and Industrial Property Laws and other relevant legislation and agreements. All such tangible and intangible assets are the sole property of MB Oyun, which retains all rights of disposition over them.

The game Zula Strike, its source code, visuals, characters, stories, dialogues, animations, sounds, music, in-game virtual assets, Zula Strike Gold, accounts, trademarks, logos, and the related websites are collectively referred to as “MB Oyun Elements” and all economic and moral rights over them belong exclusively to MB Oyun Yazılım ve Pazarlama Anonim Şirketi. The User acknowledges that they have no ownership rights over any element of Zula Strike or the Services.

The User may use MB Oyun Elements solely for personal, non-commercial purposes, under a limited, non-exclusive, non-transferable, revocable license granted for entertainment purposes. The license terminates immediately upon account closure. The User may not sell, copy, trade, lend, reverse engineer, decompile, derive source code, translate, rent, pledge, transfer, publish, or distribute MB Oyun Elements without express written consent from MB Oyun.

The User may not use robots, spiders, or other automated devices or manual processes to access, copy, or modify any MB Oyun Elements, nor may they create derivative works or publicly display them without written consent. Unauthorized use obligates the User to compensate MB Oyun and any third party for damages, including legal fees.

Any text, image, sound, or other materials submitted, uploaded, or created by the User in connection with the Services (“User Content”) remains the User’s responsibility. By submitting such content, the User grants MB Oyun a worldwide, perpetual, irrevocable, royalty-free, transferable license to use, reproduce, modify, distribute, publicly display, and create derivative works thereof.

Article 4 – Service Fees, Virtual Assets, and Payment Terms

Access to Zula Strike and basic game experience is free of charge. However, MB Oyun reserves the right to offer certain virtual products, in-game currency, and other services for a fee. MB Oyun may modify prices and billing methods at any time.

Virtual currency (“Zula Strike Gold”) and virtual items (weapons, skins, equipment, etc., collectively “Virtual Assets”) may be purchased through authorized third-party payment providers or directly via MB Oyun. All rights and ownership of Virtual Assets remain with MB Oyun; the User only acquires a license to use them within the game. Virtual Assets have no real-world value and cannot be exchanged for money, goods, or services outside the game.

All purchases are final and non-refundable, except where required by law. By purchasing Virtual Assets, the User acknowledges that they are digital goods delivered instantly and thus exempt from statutory withdrawal rights.

 

Article 5 – Code of Conduct, Prohibited Actions, and Sanctions

The User is solely responsible for their behavior, communications, and content in Zula Strike and the Services. The User agrees to respect other players, adhere to fair play principles, and preserve the integrity of the community.

Prohibited actions include, but are not limited to:

• Using cheats, hacks, bots, scripts, or any unauthorized third-party software.

• Exploiting bugs or errors for personal gain.

• Interfering with game files, servers, or communications.

• Harassing, threatening, or insulting others.

• Using discriminatory, hateful, obscene, or illegal language/content.

• Impersonating MB Oyun staff.

• Promoting illegal activities.

• Selling, renting, or trading accounts or Virtual Assets outside authorized channels.

• Performing DDoS or other attacks on servers.

Sanctions for violations may include warnings, temporary or permanent chat restrictions, temporary suspension of the Account, permanent Account ban, and deletion of illegally obtained Virtual Assets or ranks.

 

Article 6 – Account Termination by User

The User may terminate their Account or uninstall Zula Strike at any time, without entitlement to any refund or compensation. Upon written request, MB Oyun will delete or anonymize the User’s data unless retention is required by law.

 

Article 7 – Obligation to Maintain Infrastructure

The User is responsible for having the necessary internet connection and hardware to access and use the Services. MB Oyun is not responsible for interruptions or issues caused by the User’s service provider or equipment.

 

Article 8 – Disclaimer of Warranties, Service Interruptions, and Liability

The Services are provided “as is” and “as available.” MB Oyun makes no express or implied warranties that the Services will be uninterrupted, error-free, secure, or meet the User’s expectations.

MB Oyun is not liable for service interruptions caused by maintenance, emergencies, or factors beyond its control (including cyber-attacks, ISP issues, natural disasters, war, or force majeure events).

To the fullest extent permitted by law, MB Oyun’s total liability will not exceed the total amount paid by the User to MB Oyun in the six months preceding the event giving rise to the claim.

 

Article 9 – Third-Party Content and Disclaimer of Responsibility

The User acknowledges that Zula Strike and the Services are interactive platforms where other users may share content, which MB Oyun does not pre-screen or endorse. MB Oyun is not responsible for user-generated content and does not guarantee its accuracy, legality, or appropriateness.

Parents and guardians are responsible for monitoring the use of the Services by minors and for preventing exposure to inappropriate content.

 

Article 10 – Miscellaneous Provisions

Failure by MB Oyun to enforce any provision of this Agreement does not constitute a waiver of that provision.

If any provision is deemed invalid, the remaining provisions remain in effect.

This Agreement is governed by the laws of the Republic of Turkey. Any disputes will be subject to the exclusive jurisdiction of Istanbul Anatolian Courts and Enforcement Offices.

This Agreement and its annexes (Privacy Agreement and Clarification Text on the Protection of Personal Data) constitute the entire agreement between the User and MB Oyun and supersede all prior agreements.
