USER AGREEMENT

YOU MUST READ THIS USER AGREEMENT BEFORE USING OR IN ANY WAY BENEFITING FROM ANY SERVICE/PRODUCT PROVIDED BY MB OYUN YAZILIM VE PAZARLAMA ANONİM ŞİRKETİ. IN THE EVENT THAT YOU ACCESS ANY PRODUCT OR SERVICE PROVIDED BY MB OYUN IN ANY WAY, CREATE AN ACCOUNT, DOWNLOAD ZULA STRIKE, PLAY IT, OR CLICK YOUR I ACCEPT OPTION, INCLUDING PARTICULARLY YOUR USE OF ZULA STRIKE AND ANY SERVICE/PRODUCT LOCATED ON THIS WEBSITE, YOU ARE DEEMED TO HAVE ACCEPTED, UNDERTAKEN, AND DECLARED THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT AND ALL OF ITS ANNEXES, WHICH ARE AN INTEGRAL PART HEREOF, AND THAT YOU ARE BOUND BY THE PROVISIONS OF THIS AGREEMENT AND ITS ANNEXES (PRIVACY AGREEMENT AND THE CLARIFICATION TEXT ON THE PROTECTION OF PERSONAL DATA). IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT, YOU ARE STRICTLY PROHIBITED FROM USING THE PRODUCTS AND SERVICES PROVIDED BY MB OYUN, PARTICULARLY ZULA STRIKE.

Article 1 – Subject of the Agreement, Acceptance, and Agreement Amendments

1.1 The subject of this User Agreement (“Agreement”) is the determination of the rights and obligations between MB Oyun and the User regarding the use of the game named “Zula Strike” and all products and services (“Services”) provided in connection with this game, offered by MB Oyun Yazılım ve Pazarlama Anonim Şirketi (“MB Oyun”). This Agreement covers the rules and conditions applicable for the User to access Zula Strike, create an account, play the game, and benefit from all other services offered by MB Oyun.

1.2 As stated at the beginning of this Agreement; the User accepts that in the event they utilize any maps, characters, products, services, and facilities in Zula Strike belonging to MB Oyun in any manner or access the Services in any way whether connected to this or not, they shall be deemed to have carefully read, understood, and accepted this User Agreement; have been informed about the obligations contained herein, and have undertaken to comply with them. If the User does not accept the terms of this Agreement or other rules regarding the use of the Services, they must immediately cease using Zula Strike and all connected Services. The User has the right to transmit their questions, opinions, and suggestions regarding this Agreement and their negotiations regarding the agreement to MB Oyun via the https://zulastrike.zendesk.com/hc and contact@madbytegames.com e-mail addresses.

1.3 MB Oyun reserves the right, at its sole discretion, to unilaterally change, update, or amend this Agreement and any rules and policies regarding the Services at any time, for operational, legal, or other reasons. Any amendments to be made in this Agreement shall take effect immediately as soon as its updated version is published on the Zula Strike website and shall become binding for the User. MB Oyun may announce material changes to Users through in-game notifications or other reasonable communication channels, but this is not an obligation. The User's continued use of Zula Strike or the Services following the publication of the changes shall mean that they accept all provisions of this updated Agreement. If the User does not accept the updated Agreement terms, they must immediately cease using Zula Strike and all Services. It is entirely the User's responsibility to regularly review this Agreement and be aware of the current terms.

Article 2 – User Account

2.1 In order to access and benefit from the Services provided by MB Oyun, a Zula Strike account ("Account") must be created by the User. Accounts may only be created by a natural person acting in their own name and on their own behalf. By accepting this Agreement or accessing the Services, the User declares that they have the capacity to establish a legally binding contractual relationship. The User accepts that they know opening an Account and accessing the Services may require the approval of a legal representative, parent, or guardian, if applicable. In cases where such a necessity exists (minority, restriction, etc.), the User agrees to ensure that the relevant legal representative, parent, or guardian is fully and properly informed prior to participation, or to obtain the necessary permissions and request support for ensuring their attainment by transmitting the relevant and necessary information to MB Oyun for this purpose.
 

2.2 The User must be at least 15 years old in order to access the Services and benefit from them in any way. If you are older than 15 but younger than 18, meaning you are not of legal age ("Minor User"), it is deemed that you have reviewed this Agreement together with your parent or guardian and created the Account with their approval. In this case, your legal parent/guardian is deemed to have (i) given consent to the execution of this Agreement, (ii) assumed all liability that may arise from the Minor User's use of the Account and access to the Services, (iii) approved all purchases made through the Account and accepted to be held financially responsible for them. VIP subscription purchases are also included in this scope, and any paid subscription transaction to be carried out on behalf of the Minor User must mandatorily be made with the approval of the legal representative/parent/guardian.
 

2.3 It is strictly prohibited for the User to create or use an Account on behalf of any person other than themselves. All kinds of criminal and legal liabilities arising from these actions belong exclusively to the User. It is a legal necessity for the User who conducts transactions regarding the sale and acquisition of any kind of tool acquired to be used in the contents of Zula Strike and other Services to be of legal age, and it is recommended that those who cannot fulfill this requirement perform the relevant transaction and acquisition with the permission and supervision of their legal representatives, and the relevant transactions are deemed to have been executed under the supervision of the parent or guardian.
 

2.4 Zula Strike and other Services provided by MB Oyun may not be suitable for all age groups due to their content. The parent or guardian who allows the Minor User to play Zula Strike or to benefit from the Services in any way is exclusively responsible for determining whether the content of Zula Strike and the Services is suitable for their own children and for supervising them. The parent or guardian agrees to supervise the Minor User's use of the Services and to ensure that they act in accordance with this Agreement. If MB Oyun determines that these rules have been violated, it reserves the right to suspend or permanently close the relevant Accounts without prior notice.
 

2.5 The User undertakes to provide all information requested during and after the Account creation (including but not limited to e-mail address, date of birth, and other information that may be requested by MB Oyun) accurately, completely, and up-to-date, and to keep this information up-to-date. The use of identity information, e-mail addresses, or other personal data belonging to someone else or that is misleading is strictly prohibited. The User and, if the User is not of legal age, their legal representative/parent/guardian is exclusively responsible for any problems, communication interruptions, loss of rights, and damages (including the loss of access to the Account) arising from the information provided by the User being incorrect, incomplete, or out-of-date. MB Oyun has no liability in such cases. If MB Oyun suspects or determines that the provided information is contrary to the truth, it reserves the right, at its sole discretion, to suspend, freeze, or permanently close the relevant Account without prior notice. The User and, if the User is not of legal age, their legal representative/parent/guardian undertakes to hold MB Oyun harmless against any damages and third-party claims that may be suffered due to the data provided by the User being incorrect, incomplete, or outdated. MB Oyun's right of recourse against the User and their legal representative/parent/guardian in this context is reserved.
 

2.6 The User is solely responsible for ensuring the security of access tools such as the username or password presented to them or created by them in order to benefit from the products and/or services offered by MB Oyun, and for taking the necessary measures to prevent them from being seized by third parties, and is personally and solely responsible for all the results of their actions and transactions contrary to this.
 

2.7 The User is obliged to immediately notify MB Oyun the moment they realize or suspect that the security of their Account has been breached in any way or that there is unauthorized access to their Account. MB Oyun cannot be held responsible for any loss, damage, or unauthorized use arising from notifications not made in a timely manner. The User accepts that they understand no one, including MB Oyun employees, will ask for their password from them under any circumstances. MB Oyun is not responsible for any damages arising from the User's Account being seized or used by third parties as a result of the User's own negligence or fault.
 

2.8 The User may not transfer, make available to others, or subject the passwords, usernames, or any other elements created for the purpose of their utilization of Zula Strike or the Services to trade, whether with or without consideration; they may not make any claims against or towards MB Oyun regarding the results of actions and/or transactions to the contrary. The User knows and accepts that the results of all kinds of products and/or Services or games and all kinds of connected services offered by MB Oyun do not bear a nature dependent on luck or chance. MB Oyun reserves the right to terminate the memberships of the buyer and the seller of the character in the event that they subject their characters within Zula Strike to trade, with or without consideration, and if this situation becomes known. The remaining rights of MB Oyun are reserved.
 

2.9 The User may not choose and use any name possessing the characteristics specified below as an Account name or in-game character name (nickname):
    • Violating the rights of a third party or institution (trademark, person's name, etc.),
    • Creating identity deception by acting as an MB Oyun employee, manager, or support staff,
    • Obscene, vulgar, pornographic, racist, containing hate speech, containing insults or profanity, encouraging illegal activities, or contrary to general morality,
    • Containing any personal information (address, phone number, etc.),
    • Containing a commercial purpose or advertisement (for example a website address).
The authority to decide whether a name violates these rules lies exclusively at the discretion of MB Oyun. MB Oyun reserves the right to change any name it determines to have violated this rule, temporarily suspend the relevant Account, or permanently close it without giving prior notice to the User.
 

2.10 The User accepts in advance that they will comply with the "Rules of Conduct" previously determined by MB Oyun within Zula Strike, the Services provided by MB Oyun, or any platform in which MB Oyun holds rights, and that sanctions may be imposed upon them by MB Oyun as a result of the negative behaviors they will exhibit. MB Oyun has the right to make changes in the Rules of Conduct, in cases it deems necessary, without making any written notification but by publishing them on the site, and the User accepts and undertakes that all amendments or updates made in this manner are valid from the date of publication.
 

2.11 The User may not share any content in Zula Strike that constitutes a crime, requires legal prosecution, results in or encourages the violation of laws or international agreements, is illegal, threatening, disturbing, containing insults and profanity, degrading, humiliating, vulgar, pornographic or contrary to morality, contrary to generally accepted rules in society, damaging to personal rights, or of similar nature, and may not use Zula Strike in any way to make statements that constitute a crime, praise and encourage drugs and tobacco products, make statements about politicians or other legal entities, make uses that constitute an insult to the spiritual memory of Atatürk, require legal prosecution, result in or encourage the violation of laws and international agreements nationwide or internationally, are illegal, threatening, disturbing, containing insult, profanity, or slander, humiliating, vulgar, pornographic or disrupting public order, contrary to general morality, in a way that will disturb and harass others, damaging to personal rights, for an illegal purpose, or in a way that infringes upon the privacy rights, intellectual rights, trademark rights, or other property rights of others. Furthermore, they may not carry out any process that imposes an unreasonable or disproportionately large load on the Zula Strike infrastructure or contains a virus or other harmful element. All financial, legal, criminal, and administrative liability arising/to arise from such content and contradictory use exclusively belongs to the User who caused the content.
 

2.12 MB Oyun has the right not to publish the ones it deems inappropriate among the contents shared by the User in Zula Strike without stating any reason in Zula Strike. The User declares that they know they may be deprived of access to the Services temporarily or permanently by MB Oyun due to such usage situations, and that if requested, such relevant contents created by the User, if any, may be shared with official authorities and bodies by MB Oyun.
 

2.13 Users accept and undertake that, while benefiting from the products and/or services offered in Zula Strike or the Services, they will not use any names, signs, symbols, or logos that violate any right of any third party, primarily intellectual property rights, that they will not engage in actions or transactions that violate the rights and authorities of third-party persons or institutions, that they will not establish actions or transactions contrary to the laws, and that in the event the contrary is determined, MB Oyun possesses the right and authority to apply any kind of temporary or continuous measure regarding the User and their Accounts.
 

2.14 Each User may create and use only one Account. Creating, using, or controlling more than one Account may be considered by MB Oyun as a material breach of this Agreement. This rule covers all accounts opened by the same person using different e-mail addresses or identity information. If MB Oyun suspects that a User owns more than one Account, it has the right to request additional information to verify the accounts. In case of a violation of this rule, MB Oyun reserves the right to temporarily suspend or permanently close all Accounts belonging to the relevant User without prior notice.
 

2.15 It is strictly prohibited for a person whose Account has been permanently closed or banned by MB Oyun for any reason previously to re-access the Services. This ban also covers creating a new Account or using an Account belonging to another User. Any Account created or used by violating this ban may be closed immediately and unquestioningly at the discretion of MB Oyun upon its detection. All virtual assets and Zula Strike Gold obtained in this way may also be irreversibly deleted.

Article 3 – Intellectual and Industrial Rights, Limitations, and Prohibitions
 

3.1 Zula PC and Zula Battle Royale, evaluated within the scope of Zula Strike, and other versions and platforms and contents to be added in the future, all kinds of Services offered by MB Oyun in this context, and any kind of use, organization, and disposal in the text of this Agreement, every kind of product and/or service offered, are exclusively and solely the property of MB Oyun, unless stated otherwise or understood from the nature of the work; and the licenses of those belonging to third parties have been obtained by MB Oyun in accordance with the law. The phrase MB Oyun is the trademark of MB Oyun Yazılım ve Pazarlama Anonim Şirketi.
 

3.2 All kinds of in-Zula Strike content, material, document, information, graphic, design, product, in-game accounts, in-game products, e-mail services, software, update, and other similar services presented to the User by Zula Strike, without being limited to those listed herein, are legally protected by local and international Intellectual and Artistic Works Law, Industrial Property Law, and other relevant laws and conventions, and all of the tangible and intangible elements, assets, and/or subjects of every kind listed in this article are personally and exclusively the property of MB Oyun; and the licenses of those belonging to third parties have been obtained by MB Oyun in accordance with the law. MB Oyun holds the right of any kind of disposal over these assets. MB Oyun has the right to temporarily or permanently suspend, modify, or not continue, partially or completely, any kind of product or service offered on the site or all products and/or services it offers within the scope of game services. The User knows and accepts that all of those listed herein are solely the property of MB Oyun and/or their licenses have been obtained by MB Oyun in accordance with the law. With their acceptance of this agreement, the User undertakes to comply with the relevant laws while benefiting from MB Oyun services; at this point, they undertake that they alone will be responsible for all their actions and transactions contrary to the laws; they accept that for the stated reasons, they shall in no way have the right of recourse against MB Oyun, excluding MB Oyun's liability within the scope of intent and gross negligence.
 

3.3 All elements constituting the Services ("MB Oyun Elements"), including but not limited to the Zula Strike game, the game's source codes, visuals, characters, stories, dialogues, animations, sounds, music, in-game virtual assets, Zula Strike Gold, accounts, trademarks, logos, and relevant web pages, and all financial and moral rights thereto exclusively belong to MB Oyun Yazılım ve Pazarlama Anonim Şirketi pursuant to the Intellectual and Artistic Works Law No. 5846, the Industrial Property Law No. 6769, and other relevant legislation, and/or their licenses have been obtained by MB Oyun in accordance with the law. The User accepts and declares that they do not have any right under any name and manner whatsoever, primarily the right of ownership, over any element of Zula Strike and the Services.
 

3.4 The User accepts that they will use MB Oyun Elements not for commercial purposes, but only for personal purposes, and that a limited license is granted to them by MB Oyun to be used solely for entertainment purposes. This license is non-exclusive, non-transferable, and revocable. In the event the User closes their account in Zula Strike, the licenses granted to use Zula Strike shall also immediately terminate. The User does not have the right to sell, copy, trade, lend, perform reverse engineering, decompile, derive source code, translate, rent, show as collateral, transfer, publish, assign, and distribute MB Oyun Elements whose intellectual and industrial rights belong to MB Oyun. MB Oyun is the sole owner of the financial, moral, and any other rights of all kinds of MB Oyun Elements, including user accounts in Zula Strike, computer software, titles, objects, works, characters, character names, chat logs, game logs and broadcasts, locations, location names, stories, dialogues, slogans, character-specific statements, illustrations, graphics, building or landscape drawings, animations, sounds, compositions and recordings, virtual products, game currency, audio-visual effects, character likenesses, operating methods, and gameplay, and/or has obtained their licenses in accordance with the law.
 

3.5 Users accept and undertake that, except for the exceptions stipulated in this Agreement and the license granted to them, they will not use, will not make others use, and will not support actions or attempts of this kind regarding MB Oyun Elements in any of their personal or commercial activities, regardless of whether there is an income-generating purpose, without the written permission of MB Oyun; that they will not acquire the aforementioned uses or other products and/or services offered within their scope, and even if they acquire them, they will not use them in Zula Strike or in connection with the products and/or services offered in Zula Strike; in the event the contrary is determined, MB Oyun has the right and authority to apply any kind of legal, technical, or administrative measure or restriction regarding the user accounts or transactions of Zula Strike.
 

3.6 The User accepts and undertakes that they will not use any robot, spider, or other automated devices or manual processes without obtaining the explicit and written permission of MB Oyun; that they will not create derivative works from this content and will not publicly display them. The User who performs the unauthorized use accepts that they will be obliged to compensate for the damages suffered by Zula Strike and third parties, including court costs and attorney fees.
 

3.7 All kinds of text, images, audio, or other materials sent, uploaded, or created by the User to the Services via chat, forum, video, or other channels ("User Content") are under the User's responsibility. By submitting such content, the User accepts that they grant MB Oyun a worldwide, perpetual, irrevocable, royalty-free, and transferable license to use, reproduce, modify, distribute, publicly perform, and create derivative works of this content.
 

3.8 The User accepts and undertakes to never be able to use the brands, service marks, trade names, logos, domain names, slogans, and trademarks of MB Oyun.

Article 4 – Service Pricing, Virtual Assets, and Payment Terms
 

4.1 Access to the Zula Strike game and the Services provided by MB Oyun or by third parties authorized by MB Oyun, and the basic game experience are free of charge. However, MB Oyun reserves the right to offer certain virtual products, in-game purchasing currency, and other services that can be used to enhance the game experience in exchange for a fee. MB Oyun has the right to change and review the fees and billing methods from time to time in Zula Strike. These changes shall take effect immediately the moment they are included in this Agreement or published on the website and in the application. In the event a change is made to the subscription fees, the User continues to receive the service at the current price until the next renewal period.
 

4.2 Within the scope of the Services, MB Oyun may offer the User the opportunity to purchase virtual purchasing currency ("Zula Strike Gold") and virtual products (weapons, costumes, equipment, etc., collectively "Virtual Assets") that they can use to develop their in-game progression or for other visual enhancements.
 

4.3 All rights and ownership regarding Virtual Assets always belong to MB Oyun or their licenses have been legally obtained by MB Oyun; the User only acquires a license regarding the right to use them within the game. Virtual Assets do not have any real money value and under no circumstances can they be exchanged or redeemed from MB Oyun or another third party in return for real money, goods, or any other product with a monetary value.
 

4.4 Virtual Asset purchases may be executed through third-party payment service providers authorized by MB Oyun (credit card companies, mobile payment operators, etc.) or directly through MB Oyun, entirely at the discretion of MB Oyun. The terms of service and privacy policies of these providers are applicable to their own processes. The User accepts and undertakes to comply with the contracts concluded with third parties for the acquisition of Virtual Assets. The User accepts and undertakes that MB Oyun is in no way a party to the disputes arising from contractual or other matters between the User and third-party providers, and that they will not make any claims against MB Oyun due to such disputes.
 

4.5 The User accepts and undertakes that they are responsible for all purchases made through their Account using a valid payment method and for all costs arising from these transactions (including applicable taxes).
 

4.6 MB Oyun reserves the right to unilaterally change, update, or remove the prices, features, and availability of Virtual Assets at any time without prior notice.
 

4.7 ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. All kinds of transactions and transaction amounts made via Zula Strike and the Services are under the User's disposal and responsibility. The User may use whichever they find suitable among the options regarding the payment transactions offered in Zula Strike and the Services. The obligation to ensure compliance with the technical and procedural rules to which the payment option chosen by the User is subject belongs entirely to themselves. Except for the cases required by the applicable legislation, as a rule, no refunds are made for all payments made by the User and the purchased Virtual Assets. The User accepts and declares in advance that the Virtual Assets they purchased fall within the scope of "services performed instantly in the electronic environment or intangible goods delivered instantly to the consumer" pursuant to Article 15/1-ğ of the Regulation on Distance Contracts, and therefore there is no legal right of withdrawal. Exceptional refunds that MB Oyun may make entirely at its own discretion or in case of a legal obligation do not constitute a precedent or create an obligation for any future refund.
 

4.8 The User accepts and declares that they understand they will have no right to demand any refund or compensation for the Virtual Assets or Zula Strike Gold they possess in the event their Account is suspended or closed due to their violation of this Agreement.
 

4.9 The subscription services offered by MB Oyun have an auto-renewal feature. Unless canceled at least twenty-four (24) hours before the end of the current subscription period, the subscription will automatically renew under the same terms, and the relevant fee will be charged to the User's account. The subscription cancellation process is executed via the Settings > Apple ID > Subscriptions menu for AppStore users, and via the Play Store > Account > Subscriptions menu for Google Play users. The cancellation process takes effect at the end of the current billing cycle; the User continues to benefit from the VIP advantages from the date of cancellation until the end of the period.
 

4.10 In the event that Zula Strike is permanently taken out of service, a notification will be made to Users with active subscriptions a reasonable time in advance, and a proportional refund assessment may be conducted within the framework of platform policies.

 

Article 5 – Rules of Conduct, Prohibited Actions, and Sanctions

5.1 The User is exclusively responsible for all their behaviors, in-game and out-of-game communications, and all contents they create while using Zula Strike and the Services. The User accepts and undertakes to behave respectfully towards other players, comply with the principles of fair play, and protect the integrity of the Zula Strike community.
 

5.2 The actions specified below, provided they are not limited to these, are deemed a material breach of this Agreement and are a reason for sanction. Even attempting these actions shall be considered a breach. MB Oyun has the right to monitor, track, and audit the User's in-game transactions in order to detect, limit, prevent inappropriate behaviors, including but not limited to those listed below, and to improve Zula Strike.
 

Cheating and Disrupting Game Integrity:
    • Using any third-party software not authorized by MB Oyun that affects the operation of the game (cheats, hacks, bots, scripts, automation programs, etc.).
    • Intentionally exploiting any error, loophole, or bug in the game codes or system in favor of themselves or others, and/or reporting these loopholes to other players or third parties.
    • Failing to immediately report the software and technical loopholes included in the previous article to MB Oyun.
    • Interfering with, modifying, deciphering, or reverse engineering game files or server communication.
    • Creating, hosting, or playing on private servers for any version of Zula Strike without the written permission of MB Oyun.
 

Illegal and Inappropriate Communication and Contents:
    • Harassing, threatening, humiliating, shaming, or persistently sending unsolicited messages (spam) to any player or group.
    • Using discriminatory or insulting language containing hate speech on the basis of race, ethnic origin, religion, sexual orientation, gender, disability, or any other basis.
    • Sharing contents that are obscene, pornographic, contain extreme violence, or are contrary to general morality.
    • Disclosing personal information (name, address, phone number, e-mail, credit card information, etc.) belonging to themselves or another person.
    • Creating identity deception by acting as an MB Oyun employee, manager, or support staff.
    • Praising, encouraging, or discussing illegal activities (drug use, terrorism, etc.).
    • Sending messages containing chain letters, pyramid schemes, or commercial advertisements and promotions.

Breaching Account Security and the Service:
    • Selling, renting, trading, gifting, or subjecting Accounts, Virtual Assets, or Zula Strike Gold to trade in any way outside the game.
    • Attempting to seize the account information of other users (phishing, etc.).
    • Engaging in any action that will damage, place an extreme load on, or prevent the operation of the servers or networks where the Services are offered (DDoS attacks, etc.).

5.3 MB Oyun reserves the right to investigate any claim of violation, examine in-game communications (chat logs, etc.), and make the final decision regarding whether an action violates this Agreement entirely at its sole discretion.
 

5.4 In case of violation of this Agreement or the Rules of Conduct, MB Oyun has the right to apply one or more of the following sanctions without prior notice, depending on the severity and repetition of the violation:
    • Verbal or written warning.
    • Temporary or permanent restriction of in-game chat or communication capabilities.
    • Temporary suspension of the Account for a certain period.
    • Permanent closure of the Account (indefinite ban).
    • Deletion from the account of Virtual Assets or ranks determined to have been obtained through cheating or prohibited actions.
 

5.5 In the event that the products and/or Services offered by MB Oyun and Zula Strike are used contrary to the terms of use or the Rules of Conduct stipulated in this Agreement, MB Oyun holds the right to temporarily or permanently terminate the User's access to these Services. If MB Oyun acts in this manner, the User does not have any right of objection. In such a case, the obligation to destroy any kind of material, including the licenses and usage rights granted to the User during any service offered through MB Oyun, belongs to the User.
 

5.6 In the event that your Account is permanently terminated for any reason, you accept that you will not be able to claim any refund, compensation, or right for the Virtual Assets or Zula Strike Gold you possess.
 

5.7 The User accepts that in the event the User's Account is closed as a result of the application of the sanctions foreseen if actions contrary to the provisions in this Agreement or the Rules of Conduct are detected, they cannot request the refund of the money in their account in Zula Strike, and that MB Oyun has the right to stop access, and MB Oyun will have no liability whatsoever due to the termination of the use of the Account.
 

5.8 The User accepts to convey the details of the situation from the support section for the situation to be examined, if they think MB Oyun made a mistake in applying the provisions in this Agreement or if they wish to object to this situation. However, the User accepts that during the examination period, their Account may be suspended by MB Oyun and that they do not have the right to object to this suspension process.

 

Article 6 – Termination of the Account by the User

The User declares that they shall not claim any right from MB Oyun in the event they terminate their Zula Strike Account or delete Zula Strike or cease to benefit from the Services. In the event the User terminates their Account and requests it in writing, MB Oyun undertakes to destroy, delete, or anonymize the data belonging to the User upon the written request of the User, except for the data that is mandatory to be kept in this context, provided there is no legal reason to keep them legally. Zula Strike reserves the right to terminate the use of Zula Strike, close the personal page in case of violation of the terms of use; to be able to close to access and delete the information and contents uploaded to the system by the User from the access of third parties, including the User; and the right to disclose any kind of information in response to legal or administrative requests or if a criminal complaint or an official investigation request regarding the User comes from any official authority and/or if it is determined that any electronic sabotage or attack that will prevent the system from working or change its operation is carried out, and the right to apply to litigation or legal follow-up avenues against the User and the right to take the measures it deems necessary.

 

Article 7 – Obligation to Provide Infrastructure Requirements

7.1 In order to benefit from the products and/or Services offered by MB Oyun or any other kind of content listed in this Agreement, the User must have the necessary connection infrastructure and other hardware. The provision of the said necessity is the User's obligation. MB Oyun has no responsibility in this regard. Any kind of malfunction originating from service providers, the infrastructure, or the user regarding the internet connection is solely the User's responsibility.
 

7.2 In case of benefiting from any kind of products and/or Services offered by MB Oyun or all other contents listed in this agreement, the time and frequency of benefiting from the Services will be determined by MB Oyun according to the current number of users, duration, and other data.
 

7.3 It is the joint acceptance and will of the parties that the Users are primarily and directly responsible for their obligations to ensure the security of their accounts; and that they shall not have any right of claim against MB Oyun in account security problems that arise otherwise. MB Oyun cannot be held responsible for the said situation and result in the event that game accounts and/or any element in these accounts are temporarily or permanently lost or become unusable with the effect of technical reasons that may arise during the offering of any kind of games, products and/or services, or other contents and services connected to them, offered or published by MB Oyun.

 

Article 8 – Disclaimer of Warranties, Service Interruptions, and Liability

8.1 THE SERVICES ARE PROVIDED TO THE USER ON AN “AS IS” AND “AS AVAILABLE” BASIS. MB OYUN MAKES NO EXPRESS OR IMPLIED WARRANTY OR COMMITMENT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, THAT THEY WILL MEET ALL YOUR EXPECTATIONS, OR THAT ANY ERROR OR DEFECT “BUG” IN THE GAME WILL BE FIXED.
 

8.2 MB Oyun will make reasonable efforts to ensure that the Services are continuously accessible. However, the User accepts that interruptions or disruptions may be experienced in accessing the Services for the reasons stated below:
    • Planned Maintenance: MB Oyun may temporarily suspend the Services in order to update servers, perform maintenance, or add new features. MB Oyun will try to announce planned interruptions a reasonable time in advance, but this is not an obligation.
    • Emergencies and Reasons Beyond Control: MB Oyun cannot be held responsible for interruptions that occur due to reasons beyond MB Oyun's control (including cyber-attacks, problems originating from third-party service providers, internet infrastructure failures, natural disasters, war, acts of terrorism, or other force majeure events).
    • Non-Liability: Due to any interruption, slowdown, or data loss that may be experienced in the Services, the User cannot demand any right, refund, or compensation from MB Oyun.
 

8.3 Measures have been taken within the current possibilities to ensure that MB Oyun, the Services, and Zula Strike are free from viruses and similar malicious software. Besides this, in order to ensure ultimate security, the User must supply their own virus protection system and provide the necessary protection. In this context, by using Zula Strike and the Services, the User is deemed to have accepted that they are responsible for all errors that may occur in their own software and operating systems and their direct or indirect consequences. The User shall hold MB Oyun harmless in any way, except for MB Oyun's intent and gross negligence, and in the event the User Account is subjected to destruction, cancellation, alteration, falsification, hacking, and any other type of damage or loss whatsoever its nature may be.
 

8.4 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LEGISLATION, MB OYUN SHALL IN NO WAY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFIT, LOSS OF DATA, LOSS OF REPUTATION, LOSS OF ACCOUNT OR VIRTUAL ASSETS) ARISING FROM THE USE OR INABILITY TO USE THE SERVICES. MB OYUN'S TOTAL LIABILITY UNDER THIS AGREEMENT, FOR WHATEVER REASON, SHALL IN NO EVENT EXCEED THE TOTAL AMOUNT PAID BY THE USER TO MB OYUN WITHIN THE LAST SIX (6) MONTHS PRIOR TO THE EVENT CAUSING THE RELEVANT DAMAGE.
 

8.5 MB Oyun's rights to compensation due to the violation committed by the User are also reserved. Provided that; MB Oyun does not accept any liability regarding the interruption of the transaction, error, negligence, interruption, deletion, loss, delay of the transaction or communication, computer virus, communication error, theft, destruction, or unauthorized entry into, alteration of, or use of the records as a result of tort, negligence, or other reasons.
 

8.6 MB Oyun controls the accuracy and currentness of the information available in Zula Strike at periods and in ways it deems appropriate. However, despite all careful work, the information in the Services and Zula Strike may lag behind actual changes. MB Oyun makes no explicit or implicit warranty and makes no commitment regarding the currentness, accuracy, terms, quality, performance, marketability of the information and contents in the Services and Zula Strike, the suitability of the comments and opinions for a certain purpose, and their effect on other information, services, or contents that are connected or independent from these, without being limited to these, and their completeness for Zula Strike and the Services.
 

8.7 MB Oyun declares that it has taken reasonable necessary measures regarding electronic security in Zula Strike and the Services, and undertakes that in the event of an attack on the system by third parties from the electronic environment, it will take the necessary reasonable steps to the maximum extent permitted by its resources in order to prevent access to data. In the event that any information regarding any User is stolen, deleted from the system, or changed as a result of a cyber-attack carried out by third parties, MB Oyun undertakes to notify this issue within the shortest time period that can be expected from it.
 

8.8 MB Oyun is not responsible for the contents and effects of advertisements made through MB Oyun. MB Oyun reserves the right to change and update its security principles. The User, members, and visitors declare that this information has been notified to them; and that they know and accept these principles and the changes and updates in them.

 

Article 9 – Third-Party Contents and Disclaimer of Liability

9.1 The User accepts that Zula Strike and connected Services (in-game chat, forums, clan pages, etc.) are an interactive platform where other users share their own opinions, information, and materials. MB Oyun does not pre-audit, monitor, or approve all of these contents created or shared by Users ("User Content"). User Contents solely reflect the views and responsibility of the user who created the relevant content, and in no way represent the views or policies of MB Oyun.
 

9.2 The User declares that they understand they may be exposed to contents originating from other users that may be offensive, obscene, degrading, erroneous, misleading, or illegal for them while using the Services, and that they accept this risk in advance. All interactions with other users and any User Content you may be exposed to are entirely your responsibility.
 

9.3 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LEGISLATION, MB OYUN CAN IN NO WAY BE HELD LIABLE DUE TO ANY CONTENT, INFORMATION, OR MATERIAL CREATED BY USERS OR ORIGINATING FROM THIRD-PARTY SOURCES. MB Oyun provides no guarantee regarding the accuracy, legality, or suitability of such contents. The User accepts that they will not hold MB Oyun responsible for any direct or indirect damage they may suffer due to the actions or contents shared by other users. Although MB Oyun reserves the right to remove contents that violate the Rules of Conduct, it does not undertake that it will always detect or prevent all violations.
 

9.4 PARENTAL GUIDE. MB Oyun cares about the diversity of the content offered through our Services and the interaction between Users. However, we would like to state that during the use of our Services, within the materials and communications created or shared by other Users, there may be offensive language or other materials that are inappropriate for children or for some users regardless of age range. MB Oyun does not guarantee that other Users will not provide content that families and guardians may find inappropriate or that any User may find unpleasant, or that it will completely block access to such content. The Company, in principle, does not pre-screen the content of materials and communications transmitted by Users. Users and parents/guardians accept to consider this issue while using our Services and to take the precautions they deem necessary at their own discretion. Supervising children's use of our Services and preventing them from being exposed to inappropriate contents is entirely the responsibility of the parents or guardians.

 

Article 10 – Miscellaneous Provisions
 

10.1 MB Oyun's temporary non-exercise and/or late exercise of its rights and authorities arising from this Agreement does not mean that it has waived its other rights and authorities. The non-exercise of any right and authority shall not mean that the said rights and authorities will continuously not be exercised in the future.
10.2 The partial or complete invalidity of one or more provisions of this Agreement shall not affect the validity of the other provisions of this Agreement. In the event any provision of this Agreement is found invalid or unlawful by a competent court, the Parties accept and undertake to re-establish the relevant article of this Agreement in a manner closest to their wills set forth in this Agreement by the Parties.
 

10.3 In the resolution of disputes arising from the implementation of this Agreement, the commercial books and electronic records of MB Oyun have been accepted as exclusive evidence in accordance with Article 193 of the Code of Civil Procedure (CCP).
 

10.4 This Agreement shall be subject to the laws of the Republic of Turkey, regardless of its conflict of laws principles and rules. All disputes arising from or connected to this Agreement shall be subject to the exclusive jurisdiction of the Istanbul Anatolian Courts and Execution Offices.
 

10.5 This Agreement and its integral annexes, the Privacy Agreement and the Clarification Text on the Protection of Personal Data, constitute the entire agreement between the User and MB Oyun regarding the subject matter herein, and supersede all prior and contemporaneous understandings, agreements, declarations, and commitments, written or oral, regarding this subject.
